Welcome to Elevate Culture Ltd! These Terms and Conditions (“Terms”) govern your access to and use of our software-as-a-service platform, including all related tools, services, and content provided by Elevate Culture Ltd (“Company,” “we,” “our,” or “us”).

By accessing or using our services, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

Use of the Service

To enter into a legally binding agreement (such as subscribing to a paid plan, making purchases, or otherwise agreeing to contractual terms), you must be 18 years of age or older, or the age of majority in your jurisdiction.

You agree to use the service only for lawful purposes and in compliance with all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.

You are responsible for any activity that occurs under your account credentials.

Service
Elevate Culture reserves the right to make changes to the Subscription Services in its sole discretion from time to time, including the functionality, features, performance, user interface and usability and you agree that this Agreement will apply to any changes or updates to the Subscription Services.
AI Features
You are solely responsible for any text, images, or content you input into the AI Features (“Input”), as well as the material generated in response (“Output”). Both the Input and Output are considered Your Data. You must ensure that your Input and Output comply with this Agreement and all applicable Elevate Culture Ltd Policies. You agree not to include any Personal Information in your Input.

You may use your Output for any lawful purpose, but you do so at your own risk and must comply with this Agreement. If you share or distribute Output, you must clearly indicate that it was generated by AI.

You understand and accept that:

Output is generated by artificial intelligence.

Elevate Culture Ltd does not verify the accuracy, completeness, or reliability of the Output.

Output does not reflect the views or opinions of Elevate Culture Ltd.

Elevate Culture Ltd provides no warranties for the Output and accepts no liability for your use of it.

We recommend seeking independent professional advice before relying on any Output, especially if it contains advice or factual claims.

By using the AI Features, you acknowledge that your Input, including any Personal Information or commercially sensitive data you choose to include, may be shared with third-party providers such as OpenAI, LLC. These providers may use your Input to improve their services. You consent to this sharing of Personal Information if you include it.

You must not use AI Features to:

Mislead others into thinking Output is human-generated,

Provide medical, legal, or financial advice,

Create legally binding obligations,

Generate political content, source code, spam, ransomware, or viruses,

Produce offensive or shocking material, or content for legal or fully-automated decision-making purposes.

If your Output violates these terms or applicable laws, Elevate Culture Ltd may remove it, report it to authorities, and suspend or terminate your account.

Subscription, Billing, and Cancellation
Subscriptions: Access to the platform requires a paid subscription. Subscription plans, pricing, and billing cycles are outlined on our website.
Auto-Renewal: Unless you cancel your subscription before the end of your current billing period, your plan will automatically renew for the same duration and at the current rate. The renewal date corresponds to the last day of your current billing cycle (e.g., monthly or annually).

Cancellation Notice Period: To discuss cancelling your subscription you can contact the Elevate Culture Ltd, support@elevate-culture.com. To avoid being charged for the next billing cycle, you must cancel at least 30 days before the renewal date. Cancellations will take effect at the end of the current billing period.
Price Changes: We may change our subscription pricing from time to time. If we do, we’ll give you at least 30 days’ notice via email or in-app notification before the new price takes effect. If you do not agree to the new pricing, you may cancel your subscription before the changes apply.

Refunds: All payments are non-refundable, except as required by law or otherwise outlined in our Refund Policy.

License and Intellectual Property
We grant you a limited, non-exclusive, non-transferable, revocable license to use the platform in accordance with these Terms. All content and intellectual property on the platform, including software, design, logos, and trademarks, are the exclusive property of Elevate Culture or its licensors.

Data Collection and Privacy
We collect personal data such as your name and email address to operate and improve the platform. We are committed to protecting your privacy and complying with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable.

You are responsible for ensuring that any personal data you provide to us is accurate and lawful.

Data Security
We take appropriate technical and organisational steps to help keep your personal data secure. While no system can be completely immune to potential risks, we are committed to maintaining safeguards designed to protect your information.

Service Availability and Support
We aim to provide reliable and continuous access to the platform, with a target uptime of 99%, excluding scheduled maintenance.
However, we do not guarantee uninterrupted or error-free operation of the Services. Availability may be affected by factors outside our control, including but not limited to:

Internet disruptions,

Acts of nature,

Power outages,

Downtime or failures of third-party services,

Force majeure events (e.g., war, civil unrest, pandemic, natural disasters).

We will make reasonable efforts to communicate planned outages or maintenance in advance and to resolve any service interruptions promptly.

Third-Party Services
- The platform may integrate with or rely on third-party services (e.g., payment processors, cloud hosting, analytics tools).
- We are not responsible for the functionality, availability, or accuracy of third-party services and disclaim any liability arising from their use.

Prohibited Conduct
You agree not to:
- Reverse engineer or decompile the platform or its features.
- Use the service for any unlawful, fraudulent, or abusive purposes.
- Introduce malware, viruses, or other harmful code.
- Interfere with the operation or integrity of the service.

Termination
We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful. Upon termination, your right to access and use the service will immediately cease.

Disclaimer of Warranties
The platform is provided “as is” and “as available,” without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability
To the fullest extent permitted by law, Elevate Culture Ltd provides this website and its content “as is” and makes no warranties, express or implied. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, non-infringement of intellectual property rights, or any other rights.

Elevate Culture Ltd and its suppliers will not be liable for any consequential, indirect, or incidental losses or damages, whether to you or any third party arising from the use of, or inability to use, this website or its content. This applies even if Elevate Culture Ltd or its authorised representatives have been advised of the potential for such damages.

For the purposes of this agreement, “consequential loss” includes (but is not limited to): loss of profit (actual or anticipated), loss of business, revenue, benefits, opportunity, goodwill, savings, data, or reputation; and any indirect or incidental damages, whether arising in contract, tort (including negligence), equity, statute, indemnity, or otherwise.

Please note that some jurisdictions do not permit exclusions of implied warranties or limitations on certain types of damages. In such cases, these exclusions and limitations may not apply to you.

Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of England and Wales

Changes to Terms
We may update these Terms from time to time. When we do, we will notify users through the platform or via email. Continued use of the service after such updates constitutes your acceptance of the revised Terms.

Indemnification Clause
You agree to indemnify, defend, and hold harmless Elevate Culture Ltd, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from:
